ReplyDeleteMy wife and I are just over 55 and have entered the rental market in a very nice complex in Mesa, Arizona.
We are experiencing a problem with our downstairs neighbor who smokes heavily. He, and all other tenants who smoke, have been given the right to use their balcony for smoking purposes. This impacts the neighbor below or above, and we can't use our balcony, or open our windows or our sliding door at all, because it infuses our unit with smoke.
The Federal Government has issued many new studies on the effects of second hand smoke. When I talked with my neighbor nicely about this issue, and what it was doing, he held to the fact that the apartment management has told him it's fine to smoke on his balcony. They allow all smoking tenants to do the same.
Does your association plan on addressing this important issue? At our office buildings, regulations now require that smokers be outside, and at least 25 feet from the building entrance, to avoid this health issue.
My wife has lupus, and lung problems, and this is a life and death issue for her. And it is for many others.
I'm tired of listening to smokers declare their rights, when their bad health habits are impacting all those around them, costing us money and health and inconvenience.
Please advise.
